1. What information do we collect?
Personal information you disclose to us
In Short: We collect the personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you fill in a contact form on our Website, or when you otherwise contact us or hire us by phone, email, or text message.
Personal Information Provided by You. The personal information we collect depends on how you contact us and may include the following:
- your name
- your email address
- your phone number
- your preferred contact method, and whether you agree to receive text messages
- the subject and contents of your message, and any details you share about your property, trees, or project
- your business name and contact details, if you contact us on behalf of a business
- your service address and billing details, if you hire us
Sensitive Information. We do not process sensitive information.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information — such as your Internet Protocol (IP) address and browser and device characteristics — is collected automatically when you visit our Website.
We automatically collect certain information when you visit our Website. This information does not reveal your specific identity (like your name or contact information). It is used to keep our Website secure and working, and for our internal analytics and reporting. The information we collect includes:
-
Contact form technical details. When you submit a contact form, we record the date and time, the page you submitted it from, your IP address, your browser and device type, and the country your connection comes from (estimated from your IP address). We use this to prevent spam and abuse, and it is kept with your message.
-
Security checks. Our contact forms use Cloudflare Turnstile to confirm that a form is being filled in by a person and not an automated program. To do this, Cloudflare processes technical information about your browser and device.
-
Website analytics. We use Google Analytics and Cloudflare Web Analytics to understand, in aggregate, how visitors use our Website, such as which pages are visited, how long visits last, the type of device and browser used, the website that referred you, and your approximate location (city or region, estimated from your IP address). Google Analytics uses cookies with a randomly generated identifier; Cloudflare Web Analytics does not use cookies. You can turn off Google Analytics in your browser on our Cookie Policy page.
-
Server and security logs. Our hosting provider, Cloudflare, processes your IP address and basic request information to deliver our Website and protect it from attacks.
We do not collect precise location (such as GPS) information.
2. How do we process your information?
In Short: We process your information to respond to you and provide our Services, communicate with you, keep our Website secure, improve our Website, and comply with law.
We process your personal information for the following reasons:
-
To respond to your inquiries. We use the information you provide to reply to your message, answer your questions, and arrange consultations, evaluations, or quotes.
-
To provide our Services. If you hire us, we use your information to deliver the services you requested, including scheduling, invoicing, and keeping business records.
-
To communicate with you. We contact you by your preferred method, including by text message only if you have agreed to receive text messages (see Text Messaging).
-
To keep our Website secure. We use technical information to protect our contact forms and Website from spam, fraud, and abuse.
-
To understand and improve our Website. We use aggregated analytics information to see how our Website is used so we can improve it.
-
To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.
We do not use your personal information for advertising or marketing campaigns, and we do not sell it.
3. When and with whom do we share your personal information?
In Short: We share information only with the service providers that help us run our business and Website, and in the specific situations described in this section.
Vendors, Consultants, and Other Third-Party Service Providers. We share your data with third-party vendors and service providers (“third parties”) who perform services for us or on our behalf and require access to such information to do that work. They may only use your personal information to provide those services to us, and not for their own purposes such as marketing.
The categories of third parties we share personal information with are:
-
Website hosting, security, and data storage — Cloudflare hosts our Website, protects our contact forms (Turnstile), stores contact form submissions, and provides cookieless website analytics.
-
Email and communication tools — Resend delivers contact form submissions to our inbox, and Microsoft 365 provides our business email.
-
Website analytics — Google Analytics.
-
Customer records, invoicing, and payments — if you hire us, your contact details are kept in QuickBooks Online (Intuit), which we use to keep customer records, send invoices, and accept payment for our Services.
If you choose to play one of the YouTube videos embedded on our Website, the video is provided by YouTube (Google) and is subject to Google’s privacy policy.
We may also need to share your personal information in the following situations:
-
Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
-
Legal Requirements. We may disclose your information where we are legally required to do so, for example in response to a court order or other valid legal request.
We do not sell your personal information, and we do not share it with third parties for their own marketing or advertising.
4. Do we use cookies and other tracking technologies?
In Short: We use a small number of cookies and similar technologies for security and analytics. We do not use advertising cookies.
We use a small number of cookies and similar technologies (such as your browser’s local storage):
-
Strictly necessary — to protect our contact forms from spam (Cloudflare Turnstile) and to remember if you have turned off analytics.
-
Analytics — Google Analytics, to understand in aggregate how our Website is used. You can turn this off in your browser at any time using the switch on our Cookie Policy page.
We do not show advertisements, and we do not use advertising, retargeting, or social media tracking cookies, web beacons, or tracking pixels. We do not allow third parties to use tracking technologies on our Website for advertising.
The specific cookies we use, and how you can control them, are listed in our Cookie Policy.
Google Analytics
We use Google Analytics to analyze the use of our Website. It is configured not to use your information for advertising or ad personalization. You can turn it off on our Website using the switch on our Cookie Policy page, or opt out of Google Analytics on all websites by installing Google’s opt-out browser add-on. For more information on the privacy practices of Google, please visit the Google Privacy & Terms page.
5. How long do we keep your information?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.
We keep contact form submissions and our correspondence with you for as long as needed to respond to you, provide our Services, and maintain our business records, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). Google Analytics keeps detailed analytics data for no more than 14 months; summary reports that do not identify individual visitors may be kept longer.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
6. How do we keep your information safe?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. For example, our Website is only available over an encrypted connection (HTTPS), and access to stored contact form submissions is restricted to authorized people who must sign in. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
7. Do we collect information from minors?
In Short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at contact@aztreeconsulting.com.
8. What are your privacy rights?
In Short: Depending on where you live, you may have the right to access, correct, or delete your personal information, and you can withdraw your consent at any time.
Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section “How can you contact us about this notice?” below. To stop receiving text messages, reply STOP to any text message from us.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
Cookies and similar technologies: You can turn off Google Analytics using the switch on our Cookie Policy page. Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features of our Website, such as our contact forms.
If you have questions or comments about your privacy rights, you may email us at contact@aztreeconsulting.com.
9. Controls for Do-Not-Track features
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice. You can still turn off our analytics at any time using the switch on our Cookie Policy page.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
10. Do United States residents have specific privacy rights?
In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.
